By accessing and using SplitWells ("the Service"), you agree to be bound by these Terms of Service. If you don't agree to these terms, please don't use the Service.

2. Description of Service

SplitWells is a web-based typing practice application designed for users of split ergonomic keyboards, particularly the Kinesis Advantage. The Service provides typing exercises, performance analytics, and gamification features to help improve typing skills.

3. Use of the Service

You agree to use the Service only for its intended purpose: improving your typing skills.

You agree not to:

• Attempt to interfere with or disrupt the Service
• Use automated systems or bots to interact with the Service
• Reverse engineer or attempt to extract source code
• Use the Service for any illegal purpose

4. User Data

Practice data, preferences, and progress are stored locally in your browser by default. If you sign in, you can save a cloud backup to your SplitWells account. You are responsible for exporting or backing up any data you wish to preserve before clearing browser data.

5. Intellectual Property

The Service, including its design, code, graphics, and content, is owned by SplitWells and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without explicit permission.

6. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, either express or implied. We don't guarantee that the Service will be uninterrupted, error-free, or meet your specific requirements.

While we've designed the app to encourage healthy typing habits, we're not responsible for any physical strain or injury that may result from typing practice. Please take regular breaks and consult a healthcare professional if you experience discomfort.

7. Limitation of Liability

To the fullest extent permitted by law, SplitWells shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service.

8. Changes to the Service

We reserve the right to modify, suspend, or discontinue the Service at any time without notice. We may also update these Terms of Service from time to time. Continued use of the Service after changes constitutes acceptance of the new terms.

9. Paid Features

SplitWells may offer paid features such as lifetime access for unlimited practice. Payments are processed by Stripe. Unless otherwise stated at checkout, lifetime access is a one-time purchase tied to the account used during checkout. "Lifetime" means access for the commercial lifetime of the SplitWells service.

Digital purchases are generally final once access is delivered, but if you bought by mistake or the paid features do not work for you, contact support within 14 days. If a payment is refunded, disputed, or reversed, SplitWells may remove the related paid entitlement.
